Terms of Service

Last updated 31 October 2026

1. These terms

1.1 These terms of service (the "Terms") set out the agreement between you and Three Dudes Limited, a company registered in England and Wales under company number 16714605 ("Scrandella", "we", "us"), for your use of the Scrandella application and the website at scrandella.com (together, the "Service").

1.2 By creating an account or otherwise using the Service you accept these Terms. If you do not accept them, do not use the Service.

1.3 The Community Guidelines and the Privacy Policy are incorporated into these Terms by reference and form part of this agreement.

1.4 We may amend these Terms in accordance with clause 15.

2. Definitions

2.1 "Account" means a registered user account on the Service.

2.2 "Content" means any photograph, text, recipe, comment, message or other material submitted to the Service.

2.3 "Community Guidelines" means the rules published at scrandella.com/guidelines, as amended from time to time.

2.4 "Privacy Policy" means the notice published at scrandella.com/privacy, as amended from time to time.

2.5 "User Content" means Content submitted by you.

3. Eligibility

3.1 You must be at least 13 years of age. Where the law applicable to you sets a higher minimum age for a service of this kind, that age applies instead.

3.2 You must have the capacity to enter into a binding contract. If you are under 18, you confirm that a parent or guardian has consented to your use of the Service on these Terms.

3.3 You may not use the Service if we have previously terminated your Account under clause 9.

4. Accounts

4.1 You are responsible for all activity on your Account, including all Content posted from it.

4.2 You must provide accurate registration information, keep your credentials confidential, and notify us without undue delay if you believe your Account has been compromised.

4.3 You may hold more than one Account. You may not use an Account to circumvent a block, a suspension or a termination applied to another Account.

4.4 You may delete your Account at any time from within the Service. Deletion is irreversible and operates as set out in the Privacy Policy.

5. Acceptable use

5.1 The Service is provided for the purpose of sharing photographs of food prepared by the person posting them. The Community Guidelines govern what may and may not be posted, and a breach of the Community Guidelines is a breach of these Terms.

5.2 YOU ACKNOWLEDGE THAT THERE IS NO TOLERANCE FOR OBJECTIONABLE CONTENT OR ABUSIVE BEHAVIOUR ON THE SERVICE. Content which is objectionable may be removed without notice and the Account responsible may be subject to the measures in clause 9.

5.3 You shall not:

(a) submit Content which breaches the Community Guidelines;

(b) harass, bully, threaten, stalk or abuse any person;

(c) submit sexual Content, or any Content which sexualises a child;

(d) impersonate any person or misrepresent your affiliation with any person or organisation;

(e) submit spam, fraudulent material, malicious code or links to either;

(f) interfere with, overload, or attempt to gain unauthorised access to the Service or any system connected to it;

(g) scrape, index, harvest or otherwise extract Content or personal data from the Service by automated means;

(h) use the Service for any unlawful purpose or in breach of any applicable law.

6. User Content

6.1 You retain all ownership rights in your User Content. Nothing in these Terms transfers ownership of your User Content to us.

6.2 You grant us a non-exclusive, worldwide, royalty free licence to host, store, reproduce, adapt for technical purposes, and display your User Content for the purpose of operating, maintaining and promoting the Service. The licence is granted for so long as the User Content remains on the Service.

6.3 The licence in clause 6.2 terminates when you delete the relevant User Content or your Account, save that it continues in respect of (a) copies retained in routine backups for the period stated in the Privacy Policy, (b) Content already shared by other users, and (c) Content we are required to retain by law.

6.4 You warrant that you own, or are licensed to grant the rights in, all User Content you submit, and that your User Content does not infringe the rights of any third party.

6.5 We may remove User Content which breaches these Terms, the Community Guidelines or applicable law.

6.6 We do not pre-screen User Content for accuracy. Clause 11 applies.

7. Our intellectual property

7.1 The Service, the Scrandella name and marks, and all material on the Service other than User Content, are owned by us or our licensors.

7.2 You are granted a limited, revocable, non-transferable licence to use the Service for your personal, non-commercial use in accordance with these Terms. No other rights are granted.

7.3 Where you submit suggestions or feedback about the Service, you grant us an unrestricted right to use that feedback without obligation to you.

8. Moderation, reporting and appeals

8.1 Photographs submitted to the Service are assessed by an automated content filter before publication. Content exceeding our thresholds is refused. Content near those thresholds is withheld pending human review.

8.2 You may report Content and Accounts from within the Service. Reports concerning child safety, sexual Content or threats of violence are prioritised.

8.3 You may block any Account, which prevents that Account from interacting with you and removes it from your view of the Service.

8.4 Where we remove your Content or apply a measure under clause 9, you may appeal through the Help function within the Service. Appeals are determined by a person and not by the automated filter.

9. Enforcement and termination

9.1 Where you breach these Terms or the Community Guidelines, we may take one or more of the following measures: removal of the Content; a warning; suspension of your ability to post or comment for a defined period; or permanent termination of your Account.

9.2 Measures are ordinarily applied progressively, in the sequence published in the Community Guidelines. Certain breaches, identified in the Community Guidelines, result in immediate termination.

9.3 We may suspend or terminate your Account immediately where we reasonably consider it necessary to protect users, to comply with a legal obligation, or to respond to a credible risk of harm.

9.4 You may terminate this agreement at any time by deleting your Account.

9.5 Clauses 6.2 to 6.4, 7, 10, 11, 12, 13, 16 and 17 survive termination.

10. Copyright complaints

10.1 If you believe Content on the Service infringes your copyright, contact us at hello@scrandella.com with: identification of the work; identification of the Content complained of and where it appears; your contact details; a statement that you believe in good faith that the use is not authorised; and a statement that the information in the notice is accurate.

10.2 We will review complaints and may remove Content and apply measures under clause 9 to Accounts which repeatedly infringe.

10.3 Where your Content is removed following a complaint, you may appeal under clause 8.4.

11. Disclaimers

11.1 The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we exclude all warranties, conditions and representations not expressly set out in these Terms.

11.2 CONTENT ON THE SERVICE IS SUBMITTED BY USERS AND IS NOT VERIFIED BY US. We do not check recipes for accuracy or safety, we do not verify calorie figures, and we do not hold information about allergens in any dish shown.

11.3 Calorie figures displayed on the Service are entered by the user who posted the dish. They are not calculated or verified and must not be relied upon for any medical, dietary or nutritional purpose.

11.4 You are responsible for your own decisions about what you prepare and consume. If you have a food allergy, an intolerance or a medical condition, you must not rely on the Service.

11.5 We do not endorse any user, Account or Content.

11.6 We do not warrant that the Service will be uninterrupted, timely, secure or error free.

12. Liability

12.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.

12.2 Subject to clause 12.1, we are not liable for: Content submitted by other users; loss or damage which was not reasonably foreseeable at the time this agreement was formed; loss of profit, revenue, business, goodwill or anticipated savings; or loss or corruption of data.

12.3 Subject to clause 12.1, our total aggregate liability arising out of or in connection with this agreement is limited to one hundred pounds (£100).

12.4 If you are a consumer, nothing in these Terms affects your statutory rights, and clauses 12.2 and 12.3 apply only to the extent permitted by the Consumer Rights Act 2015.

12.5 The Service is supplied for domestic and private use. If you use the Service for any commercial purpose we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

13. Your liability to us

13.1 Where you breach clause 5.3 or clause 6.4 and a third party brings a claim against us as a result, you shall be liable for the losses and reasonable costs we incur in connection with that claim.

13.2 Clause 13.1 does not apply to the extent the claim arises from our own breach, negligence or failure to act on a report properly made to us.

14. Availability and changes to the Service

14.1 We may modify, suspend or withdraw any part of the Service. Where a change materially affects you we will give reasonable notice, unless the change is required urgently for legal or security reasons.

14.2 We are not liable for any failure or delay in performance caused by events beyond our reasonable control.

15. Changes to these Terms

15.1 We may amend these Terms. The date at the head of these Terms records when they were last amended.

15.2 Where an amendment materially affects your rights or obligations, we will give notice within the Service before it takes effect. Your continued use of the Service after that date constitutes acceptance of the amended Terms.

15.3 If you do not accept an amendment, your remedy is to delete your Account under clause 9.4.

16. App stores

16.1 The Service is distributed through the Apple App Store and may be distributed through other platforms. This agreement is between you and us only, and not with Apple or any other platform operator.

16.2 Apple has no obligation to furnish maintenance or support in respect of the Service.

16.3 In the event the Service fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the Service.

16.4 We, and not Apple, are responsible for addressing any claim relating to the Service, including product liability claims, claims that the Service fails to conform to a legal requirement, and claims arising under consumer protection legislation.

16.5 We, and not Apple, are responsible for the investigation, defence, settlement and discharge of any third party claim that the Service infringes intellectual property rights.

16.6 Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.

16.7 You confirm that you are not located in a country subject to a relevant trade embargo and are not listed on any applicable prohibited or restricted party list.

17. General

17.1 These Terms, together with the Community Guidelines and the Privacy Policy, constitute the entire agreement between you and us in respect of the Service.

17.2 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.

17.3 A failure or delay by us in enforcing any provision does not constitute a waiver of that provision.

17.4 We may assign or transfer our rights and obligations under these Terms. You may not assign or transfer yours without our prior written consent.

17.5 Save as set out in clause 16.6, a person who is not a party to these Terms has no right to enforce any of its provisions.

17.6 Notices to you may be given within the Service or by email to the address registered to your Account. Notices to us must be sent to hello@scrandella.com.

17.7 These Terms and any dispute arising out of them are governed by the law of England and Wales.

17.8 The courts of England and Wales have jurisdiction over any dispute arising out of these Terms. If you are a consumer resident elsewhere in the United Kingdom or in the European Union, you may bring proceedings in the courts of the country in which you reside, and you retain the benefit of any mandatory consumer protection provisions of that country.
